Tapu, The Title Deed in Turkey

When you want to buy a property in Turkey, it is necessary to know what the documents are that prove the buyer’s ownership for a specific property are known by different names. Such as the title deed in most Arab countries or Tapu in Turkey.. And the deed of sale in some countries.

Among the many meanings, it is as the legal right to own the immovable assets, in particular land or properties in all their forms. Moreover, it is the legal document that show that you have the right of ownership.

In properties, when you buy a property, you obtain the legal ownership of the asset through a legal process that is known as (property registration)..That is occurring in The Tapu Department in Turkey. Through this process, transfer of title to your name takes place. This document of the process of owning real estate assets legally is known as Tapu in Turkey.

 

What is the difference between the deed of sale and Tapu?

The deed of sale is a deal and Tapu is a statement. Although one helps to complete the other.. But the deed of sale is in the form of contracts and documents. Moreover, the deed of sale contains the property characteristics, the terms and conditions related to the sale on the basis of which, the completion of the transaction between the seller and the buyer was approved.

As to Tapu, it is your title deed, meaning that it is a statement of your ownership of one of the real estate assets in Turkey in whole or in part which you can obtain after completing the sale process and reviewing Tapu Department in Turkey which is the only department where you can register the ownership of real estate assets in Turkey.

 

How to get Tapu in Turkey?

The process of transferring ownership and obtaining Tapu occurs in the Real Estate Register Department. Moreover, that is by getting a prior appointment and the attendance of the seller

and the buyer or their representatives.

 

The necessary papers for the transfer of ownership in Tapu Department:

  • The seller’s identity, copy + original.
  • E-DEVLET for the seller to get a prior appointment electronically.
  • A copy of Tapu that the sellers wants sell to get the property’s information.
  • The price of the property, the value that will be shown in the title deed which may be different from the real value of the property.
  • Fill out the identity application for the seller and the buyer.
  • A clearance for the property that you can extract it from the municipality which the property belongs.
  • A copy of the buyer’s passport translated in to Turkish + the original passport.
  • The real estate evaluation.
  • These are the most important conditions of ownership of the property by a foreigner in Turkey.
  • The identity of the agent if there is an agent for the seller or the buyer.
  • Buyer’s tax number which you can get electronically.
  • Sworn translator’s presence in case the buyer, the seller or both do not speak the Turkish language.
  • Personal photographs of the buyer.

 

So after getting the requested papers ready and obtaining the appointment electronically, a message is sent to the buyer’s number or the agent which contains a short video stating the payment that the buyer must pay before attending to complete the transfer and obtain the title deed and this payment is the ownership tax of the property that is equivalent to 4% of the property’s value that will be shown in Tapu Department in addition to the value of added tax which may sometimes reach 1%.

After that, the seller and the buyer or their representatives are summoned to appear before the title deed officer to complete the transfer and obtain the title deed.

 

How long does the process of obtaining the title deed in Turkey?

The measures of transferring the deed are kind of quick in Turkey. Therefore, it does not take more than two to four days as of the date of signing the purchase contract, preparing the necessary papers

and extracting the real estate valuation’s report.

Thus, the title deed is delivered to the buyer or his representative after completing the transfer during minutes.

  • EDİNME SEBEB: detailed information about the property, the real owner, the person that the property sold to him
  • İŞLEM BEDELİ: the property value
  • KONUM BİLGİSİ: the address information
  • Finally, TESCİL TARİHİ- YEVMIYE NO: registration’s number and date
